Terms & Conditions



The following terms and conditions of sale apply to services provided by Broadview Instrumentation Services, Inc. referred to herein as 'Broadview'. The customer purchasing goods or services from Broadview is referred to herein as the 'Customer'. The Customer's acceptance of the goods or services provided by Broadview shall manifest the Customer's assent to the following terms and conditions. However, Broadview reserves the right, in its sole discretion, to refuse any purchase order submitted by the Customer.


SHIPPING

The following documentation must accompany a unit being sent to Broadview for calibration and/or repair:
  • 1. A copy of this quotation.
  • 2. Your purchase order with pre-approval for calibration and/or repair services.
  • 3. Return shipping information (e.g. FedEx/UPS account, preferred shipping method, shipping insurance amount).
  • 4. Calibration Specifications (e.g. points, tolerances/specifications, calibration intervals).
  • 5. Any relevant information that will assist in the calibration and/or repair of your unit (e.g. performance report, detail information regarding failure, circumstances and variables).

EVALUATION FEE

Broadview charges a standard evaluation fee at the actual hours incurred at the current rate of labor for a metrologist's initial assessment of customer equipment. Equipment will be returned 'AS IS' and an evaluation fee will be applied if no response is received within 10 days after communicating with an issue, a customer does not wish to have the equipment repaired and/or calibrated, or the repair is unable to be completed due to obsolete equipment or lack of support from the original equipment manufacturer (OEM).


CALIBRATION SERVICES

Broadview provides the following calibration services for all equipment:
  • Calibration accredited to ISO/IEC 17025, and measurements traceable to SI units through an NMI.
  • Calibration to manufacturer or internally generated procedure (in the absence of a specific customer requirement).
  • Before/After data with measurement uncertainties.
  • Uncertainty of standards utilized for calibration will meet a test uncertainty ratio (TUR) of 4:1 or better unless otherwise stated.
  • Provide statements of compliance (see Terms and Conditions).
  • Temperature and relative humidity data under which the calibration work was performed.
  • A calibration sticker which includes calibration date, due date, and technician's initials will be affixed to each instrument except where it will interfere with the equipment's functionality.


CALIBRATION SERVICES (ANSI/NCSL Z540.3 OR ANSI/NCSL Z540-1 COMPLIANT ONLY)

Broadview provides the following calibration services only for each equipment requiring compliance to ANSI/NCSL Z540.3 or ANSI/NCSL Z540-1:
  • Calibration accredited to ANSI/NCSL Z540.3 and/or ANSI/NCSL Z540-1, and measurements traceable to SI units through an NMI.
  • Calibration to manufacturer's procedure (in the absence of a specific customer requirement).
  • Before/After data with measurement uncertainties and guard banding.
  • Uncertainty of standards utilized for calibration will meet a test uncertainty ratio (TUR) of 4:1 or better unless otherwise stated.
  • No statements of compliance will be reported on certificate of calibration.
  • Temperature and relative humidity data under which the calibration work was performed.
  • A calibration sticker which includes calibration date, due date, and technician's initials will be affixed to each instrument except where it will interfere with the equipment's functionality.


EXPEDITED CALIBRATION SERVICES

Expedited calibration services are available with a surcharge. Expedited service fees vary depending on type of equipment and availability. Please contact Broadview for exact pricing and turn-around time.


ON-SITE CALIBRATION SERVICES

An agreement between Broadview and the Customer via phone, email, purchase order, etc. is required prior to Broadview performing on-site work. Once confirmed, the Customer becomes liable for a minimum charge of the hourly rate per technician per day or for payment of 100% of the quoted amount of actual work performed, whichever is greater, plus travel charges. A cancelation notice must be received by Broadview from the Customer before 24 hours of scheduled on-site work in order to cancel and avoid charges. Broadview reserves the right to postpone on-site services due to inclement weather or other unforseen circumstances.


STATEMENTS OF COMPLIANCE

It is the Customer's responsibility to provide Broadview with calibration specifications to make compliance decisions. If specifications are not provided and no historical data is present, Broadview shall report AS FOUND/AS LEFT data without making a statement of compliance. At times, the customer shall request us to calibrate to manufacturer's specifications. We cannot guarantee that we have specifications for all equipment. In the absence of not having specifications or the cusomter not providing them in a timely manner we shall report the AS FOUND/AS LEFT data as stated. When compliance statements are present, they are reported without factoring in the effects of uncertainty.
Unless otherwise contractually specified, a binary decision rule, utilizing simple acceptance, and simple rejection criteria will be used for the determination of compliance:
  • The acceptance zone is defined as: less than or equal to the high limit, and/or greater than or equal to the low limit.
  • The rejection zones are defined as greater than the high limit and/or less than the low limit.
  • Single measurement results in the acceptance zone are identified as 'Within Spec'.
  • Single measurement results in the rejection zone are identified as 'Out of Spec'.
  • When all measurement results are in the acceptance zone the equipment is identified as 'Within Spec'.
  • When one measurement results in the rejection zone the equipment is identified as 'Out of Spec'.


FREIGHT ON BOARD

Domestic delivery shall be F.O.B. origin. Title and risk of loss shall pass to Customer when products are delivered to Carrier unless otherwise agreed to in writing by Broadview. Upon request by Customer, Broadview shall prepay and invoice Customer for freight,shipping/handling, and insurance costs. International orders shall be F.O.B. factory/EX works. Freight and insurance for international shipments may be provided for a fee upon request. No order is assignable without Broadview's prior written approval.


RECORD KEEPING

Broadview will maintain records of calibration and repair history in the Broadview system for a minimum of seven (7) years. Please contact Broadview for historical record needs.


PAYMENT

For all new Customers, Broadview does not accept purchase orders. All orders must be paid with credit card. Credit card information must be provided before any services will be performed by Broadview. Once Customer has established a line of credit with Broadview, the Customer is welcome to send in equipment on a purchase order. This may be sent via fax or email.

100% of the invoiced amount is due in U.S. Dollars within 30 days from date of invoice on approved credit, unless otherwise stated in writing by Broadview. Broadview may modify payment terms if, in its sole opinion, the payment record or financial condition of Buyer is warranted. Late payments are subject to 8% interest per month on the unpaid balance. Prices exclude any tax or duty now or hereafter imposed upon the production, storage, sale, transportation, or use of the products.

Broadview accept the following forms of payment:
  • Credit Cards: Visa, MasterCard, or American Express
  • Personal, Corporate or Cashier checks
  • Electronic Funds Transfer (EFT) or Wire Transfer

  • Broadview does not accept Discover Card or pre-paid credit cards at this time.

DELAYED PERFORMANCE

Broadview shall not be responsible for non-delivery or delay in performance when such delay is beyond its control (directly or indirectly, caused by, or in any manner arises from, delay or failure to deliver by Broadview's suppliers, fires, floods, accidents, riots, war, govermental interference or embargoes, strikes or shortage of labor, or other causes whether or not similar ot those specified). Delivery shall be deemed suspended so long as such causes delay performance. Broadview agrees to make and Customer will accept deliveries at reasonable time after remedy of such causes.


ADDITIONAL TERMS

The following additional terms apply:
  1. Total cost is billed on completion, net 30 days.
  2. Broadview is not responsible for any services that have not been communicated in advance by the customer.
  3. Purchase order or credit card is required to authorize the start of work.
  4. Discrepancies between the quoted items and those that Broadview performs services will affect quoted costs.
  5. Broadview charges a standard evaluation fee for a technician's initial assessment of customer equipment.
  6. Failure to provide a tax exempt certificate or otherwise that an order is taxable will result in an order being held prior to shipping.
  7. This quote and associated documentation are valid for thirty (30) days after quotation.
